New Service Rules 2014 - Gazette Notification

In exercise of the powers conferred by article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules regulating the recruitment and condition of service of persons appointed to the Haryana Civil Medical (Group A) Service.

Inviting complete case related to resignation and VRS

It has been observed the cases for Resignation and VRS of doctors are being received incomplete at the head quarter. So vide memo no 20/2-7EII-2014/3046-73 dated 22/07/2014 the DGHS has asked all CMOs' and PMOs' of Haryana to forward  the complete cases related to Resignation and VRS with the following details.

Vide memo no 7/3-7EII-2014/3041-73 dated 22/07/2014, The DGHS has again asked to send the cases of those MO's who are eligible for completion of probation, with following details so that the matter may be taken up with Govt. accordingly.

H.C.M.S. ASSOCIATION LEADS THE WAY

ALL INDIA FEDERATION OF GOVERNMENT DOCTORS' ASSOCIATIONS FORMED
Dear Friends, 
I am pleased to inform you that the H.C.M.S. Association has created another landmark.
For the past more than 4 years, we have been working towards bringing the Doctors’ association of various states in India on a common platform. This idea was a result of our understanding that Doctors in various states are fighting lonely battles in respective states for issues which are present in each and every state. We believed that a common platform and concerted action in a common direction is required at the national level especially when most of the health policies are now being decided at the central level rather than at the state level.
With this thought in our minds, we started contacting the various state bodies in India. In this relation, we travelled to Punjab, Himachal Pradesh, Uttarakhand, Uttar Pradesh, Delhi and Madhya Pradesh to have one to one interactions with the respective state associations. We managed to develop a steady contact with the various state bodies. Over a period of time, we were able to establish personal rapport with the leaders of in-service Doctors of a large majority of the states of India.
Building upon this groundwork, the HCMS Association organized a two day ‘National Seminar on Government Health Sector in India - Challenges and the Way Forward’ on 19-20th July 2014 at Hotel Red Bishop, Panchkula.
The seminar was graced by the presence of state office bearers from 15 states of India- Arunachal Pradesh, Assam, Bihar, Chhattisgarh, Delhi, Gujrat, Himachal Pradesh, Kerala, Madhya Pradesh, Punjab, Rajasthan, Uttar Pradesh, Uttarakhand and West Bengal besides Haryana. The delegates from the different states had a very fruitful exchange of ideas and reached a consensus to form ‘ALL INDIA FEDERATION OF GOVERNMENT DOCTORS' ASSOCIATIONS’. A Steering Committee of the federation was formed with one member from each participating association as a member. Dr Ashish Rana, General Secretary, H.C.M.S. Association was elected as the Convener of the steering committee and Dr Rajesh Khayalia as a Member of the steering committee.
The next meeting of the federation will be held in Vadodara (Gujrat) in November 2014 for which even more state bodies have already confirmed participation.
We are sure, that with your best wishes and co operation, we shall be able to make this Federation a vibrant and strong body which will act as the true representative of the Government Doctors serving in the various states of India.

Blue Light Restored for CMO

The official vehicles of the Civil Surgeons of Haryana were deprived of using any beacons recently.
It was taken by us to be an assault on the dignity of the chair. The issue was taken up by the Association and we are pleased to inform that the official vehicles of our Civil Surgeons have now been allowed to continue to use Blue Beacons.
Lets keep the faith and be united.

HCMS(Group A) Service Rules 2014

Dear Doctors,
Today is a momentous day. It is a day which will long be cherished and thanked.
After a long struggle, the government of Haryana has finally approved new service rules for doctors in the cabinet meeting held today in Chandigarh.
On behalf of the State Executive I would like to congratulate each one of you for your unstinted support, faith, constructive criticism, motivation and unity.
I would take this opportunity to explain some salient features of these new rules as approved by the cabinet are notified in the next few days– 
1. The doctors have till now been placed at Group B with the pay scale of 14880 + 5400 (PB-2) at entry level and used to attain Group A status on completion of probation period when they were placed in PB-3. Now the doctors will be Group A at the entry level itself and the starting pay scale would be 15600+5400 (PB-3). This will place us at par with the Doctors of Government of India and the neighboring states.
2. As you are aware, presently 25% of the posts of SMOs in the department are reserved for direct appointment through HPSC. Till now only doctors having MD/MS degrees to their credit are eligible for the same. In these rules, the doctors having PG Diploma to their credit will also be eligible for direct appointment as SMO through HPSC.
3. Till now, there were two separate sets of service rules- HCMS (Group A) Service Rules 1981 for SMOs and above, and HCMS (Class II) Service Rules 1978 for MOs. Now both these rules stand repealed. Now all the Doctors in service, from the junior most MO to DGHS, will be governed by a single set of service rules – HCMS (Group A) Service Rules 2014.
These changes carry immense implications:-
Now the Doctors of Haryana will be at par with Doctors in other states in terms of status and pay scale at entry level. It will help attract more Doctors to service, which in turn will help reduce the burden on Doctors.
In the sixth pay commission, officers of the Group A were given 15600+5400,PB 3 while those of Group B were given 14880 + 5400,PB 2. Normally, the next pay commission can be expected to follow the pattern of the previous pay commission. This would have placed us at a very disadvantageous position had the Doctors been Group II at the time when seventh pay commission comes into force.
There were also apprehensions that like the entry level pay scales, if different apex pay scales are offered to Group A and Group B services at any time by the Government, then the loss caused to us would be immense.
Earlier, the Doctors with PG Diploma used to be denied the opportunity for promotion as SMO through HPSC. Now they will also be eligible. It will help in boosting their morale, open up new career avenues for them and attract new specialists to the job, hence helping in reduce the burden of existing specialists. Earlier, we used to notice that our Doctors going for in service PG used to opt for Degree courses in branches not of their choice instead of Diploma courses in the branch of their liking simply because of this difference. Now Doctors will not be hesitant to take up the branch of their choice simply because they were being offered diploma, not degree.
Earlier, whenever any demand of Doctors had financial implications, the government invoked the principle of parity and used to claim that if the demanded benefit was accorded to HCMS Doctors then other services at par with HCMS will also demand the same. Now, the principle of parity will be applicable in regard to a lesser number of services and would weaken the excuse of the government.
And, henceforth all the HCMS Doctors will be governed by a single set of rules.
This is a result of our unity.

Direction by DG Social Justice and Empowerment regarding Old age samman

Vide letter no 6450-70/P3/OAP/SJE/2014 dated 09/04/2014, the Director General, Department of Social Justice and Empowerment, Haryana, issued direction to all the District Social Welfare Officers of Haryana regarding procedure and requirements for old age pension. One of the important direction is that no Social Welfare officer will sent the applicant of Old Age Pension to the team of doctors for age assessment.

Submission of views to 7th CPC 26-05-2014

The HCMS Association is the sole body representing the interests of allopathic doctors working for Government of Haryana in the Department of Health and ESI Health Care haryana. With reference to the public notice on submission of views regarding 7th CPC, the HCMS Association submit its views to Secretory, 7th Central Pay Commission on 26.05.2014.

Instruction for Emergency Treatment and Referring

Vide Memo no 3PM/2014/4798-5439 dated 28-05-2014 the Director General Health Services, Haryana issued the instruction for emergency treatment and referring the Medico Legal and other cases to higher centers.

Promotion order MO's dated 22-04-2014

Governor of Haryana is pleased to promote the following MO's to SMO/ Dy.CS/ DD with immediate effect vide order no. 18/55/2009-5HB-1 Chandigarh dated 22 April 2014.

Whether HCMS doctors can be drafted in General Election duty?

The Chief Electoral Officer w.r.t. the election duty of HCMS doctors clearly says, "Whenever the HCMS doctors are drafted in election duty it may be ensured that medical facilities for public may not suffer". (click to view letter)
It is also mentioned in Handbook of Returning Officer 2014 (chapter III, point 3.3.1, Exempted categories) that the Commission has exempted the medical staff including doctors, nurses, ANM etc in view of their essential nature of duty/service discharged by them. Regarding completion of Probation of MO

Vide memo no 7/3-7EII-2914/421-27 dated 30/01/2014 The DGHS has asked to send the cases of those MO's who are eligible for completion of probation with following details so that the matter may be taken up with Govt. accordingly.

PG Policy Amendments 04/03/14

Existing higher study policy which was circulated by the department on dated 23/12/11, 30/05/12 and 11/03/13 is hereby amended. The amendments are applicable from 2014-2015 academic session. A few highlights are as under:
  • Doctors who had acquired PG diploma before entering the service and want to appear for PG degree of any stream mentioned in this policy, mandatory rural service of two year will not be required. LSA/EMOC and USG trained are also exempted. However they have to complete four years of regular satisfactory service.
  • Doctors can do PG before completion of fours of service provided he has completed two year of satisfactory service/after successful probation period. This period will be treated as Extra Ordinary Leave (EOL).
  • Doctors who wishes to do PG in any other speciality (beyond the list given in PG policy) in private institution will have to seek EOL.
  • If a doctor has not completed compulsory service after PG, he shall deposit their bond money @ 10% as simple interest from the date of concerned remained absent from job.

Mandatory Rural for ACP, Amended.

Govt has amended the rural service condition for giving ACP Scales vide Memo no 10/4/2013-3HB-l dated 07-02-2014 o/o Principal Secretory to Haryana Govt. Health department.
The medical officer should have completed at least 3 years of rural service in rural PHC's at only first 2 stages of ACP.i.e. two year rural service before grant of 1st ACP and one year rural service before grant of 2nd ACP.
All specialists (degree and diploma) and doctors trained in EMOC, LSA, USG shall be exempted for rural services.

Mass CL 8th and 9th Nov.2011 Sanctioned

Govt of Haryana has decided to treat Mass CL taken by doctors on a call by Haryana Civil Medical Sercices Association as leave of kind due. i.e. 8th and 9th of November 2011 vide Memo no. 13/41/2013-3HB-l dated 07-02-2014 o/o Principal Secretory to Haryana Govt. Health department.
